In a momentous ruling dated May 9, 2024, the High Court of Himachal Pradesh, led by Hon’ble Justice Tarlok Singh Chauhan and J. Sushil Kukreja, issued a comprehensive order addressing critical environmental issues and waste management practices within the state. The order encompasses a wide array of directives aimed at bolstering compliance with environmental regulations, streamlining waste management processes, and enhancing accountability among stakeholders.

Key Highlights of the Order

1. Comprehensive Solid Waste Management Strategy
– Shimla designated as a model town for solid waste management.
– Municipal Corporation instructed to amend laws aligning with environmental statutes.
– Specific directives for waste management from large gatherings and events.

2. Land Allocation for Solid Waste Management
– Deputy Commissioners directed to monitor land allocation activities regularly.

3. Addressing Land Availability and Creating Buffer Zones
– State Government mandated to provide necessary land for waste management facilities.
– Creation of buffer zones around solid waste management sites emphasized.

4. Imposing Penalties and Rationalizing User Charges
– Urban Local Bodies instructed to impose penalties for violations and rationalize user charges.

5. Eliminating Hot-Spots and Enhancing Public Awareness
– Dedicated teams formed to eliminate waste hot-spots.
– Emphasis on Information, Education, and Communication (IEC) activities for public awareness.

6. Ban on Plastic Flexi Banners and Conducting Waste Audit
– Consideration of banning plastic flexi banners to Chief Secretary.
– Strengthening Extended Producer Responsibility (EPR) compliance.

7. Solid Waste Management Charges
– Clarification on solid waste management charges for hilly areas.

8. Legacy Waste at Kenduwal Site
– Directives issued for the removal of legacy waste posing a threat to the environment.
