BJP MP Harsh Mahajan Issued Notice By HC in Response to Cong Candidate’s Petition

The Himachal Pradesh High Court has issued a notice to newly elected BJP Member of Parliament Harsh Mahajan in response to a petition filed by the Congress candidate Abhishek Manu Singhvi regarding the Rajya Sabha elections. The hearing of the case took place in the High Court on Saturday.

After hearing arguments from the petitioner’s side, Justice Ajay Mohan Goyal’s court issued a notice to Harsh Mahajan, who emerged victorious in the elections, and appointed him as the respondent. The next hearing in this matter is scheduled for May 23.

In the petition, Singhvi argued that if two candidates receive an equal number of votes, the formula for drawing lots is flawed. Typically, the candidate whose name appears on the ballot should be declared the winner. Therefore, if this assumption is incorrect, then the election result is also flawed. While there is no such rule in law, a challenge has been made to the court regarding one interpretation of the rule.

Background:
It is worth noting that elections were held in Himachal Pradesh for one seat in the Rajya Sabha on February 27. In this, including three independent MLAs, six Congress rebel MLAs voted against the official Congress candidate Abhishek Manu Singhvi. In the 68-member Himachal Pradesh Legislative Assembly, both candidates received 34-34 votes. After a tie, the lottery system was used to determine the winner. The ballot revealed Singhvi’s name, and BJP candidate Harsh Mahajan was declared the winner.
