Delhi court gives parole to Gaurav in junior wrestler Sagar Dhankar murder case
2 min readNew Delhi, Nov 2 – A Delhi Court Wednesday granted parole to Gaurav Lora, one of the accused arrested along with Olympian wrestler Sushil Kumar and 17 others in connection with junior wrestler Sagar Dhankar murder case.
Counsel for Gaurav Laura moved the parole application submitting that accused is a student of the National Institute of Open Schooling and is studying in class 12th and the final exams of the same are scheduled to be held on November 5, 2022 and November 9, 2022 as per exams schedule.
He has further submitted that he has also filed a copy of Hall Ticket/Admit card and the exam center of the applicant are Delhi Public School, Bahadurgarh Jhajjar Road, Lowa Khurd, Bahadurgarh, Jhajjar, Haryana and the scheduled time of the said theoretical exam is from 2:30 P.M. to 5:30 P. M. on 05.11.2022 and 2:30 P.M. to 4:00 P.M. on 09.11.2022 and the students have been directed to report at the exam center at least one hour prior to the scheduled time. So applicant may be granted custody parole for appearing in the above-said exams.
Government Counsel opposed the application and submitted that the applicant has to be taken in another state for the said exams and it will cause an unnecessary burden of expenses on the State since an extra escort has to be sent along with the applicant/accused.
Counsel for Laura submitted that in case of custody parole is granted to the applicant/accused, the applicant is ready to incur expenses of Rs. 20,000/- and prayed that rest of the expenses may be borne by the State.
Additional Sessions Judge Shivaji Anand after hearing submission on both sides said, ” considering the fact that applicant/accused was earlier granted parole on the ground of exam.
The prosecution had alleged in the matter that the manner in which Sagar and three others were abducted and brought to Chhatrasal Stadium and after that beaten up mercilessly showed that they wanted to establish their supremacy.
The prosecution contended that there is sufficient evidence to show the intention of the accused persons to kill Sagar Dhankar.
Counsel for Sushil Kumar vehemently opposed by submitting in the court that this is not a case of section 302 (murder) but of 304 (culpable homicide not amounting to murder) IPC.
Wrestlers Sagar and Sonu were allegedly beaten up in Chhatrasal stadium on the night of 4 May 2021. Sagar had succumbed to injuries during treatment in the hospital.
