“Pension Arrears on Revised Pay Scale Await Clarity Despite Court Orders”

In response to numerous inquiries from Distinct Treasury Officers and pensioners, concerns have arisen regarding the payment of pension arrears on the revised pay scale. The issue pertains to arrears covering the period from January 1, 2016, to January 31, 2022, based on court directives that include an interest component.

The matter was forwarded to the Finance (Pension) Department for clarification, which, in turn, has provided the following advice:. The government has not decided on the payment of arrears, except as indicated in the official memorandum No.Fin(Pen)A(3)-1/2021 dated September 17, 2022. In specific instances, such as Dr. Sunil Kumar Char’s case (CWP No. 5651 of 2023), the Finance Department recommended pursuing LPA/Review petitions in the Higher Court.

Similar recommendations have been given in other analogous cases, advising departments to continue the payment of arrears in higher appellate courts. The responsibility for the disbursement of arrears, per government decisions, lies with the respective DD0s/DTOs. The lack of a concrete decision on this matter despite court orders raises concerns, and further examination and resolution are awaited. Stakeholders are urged to act accordingly.
