Man Sentenced to Four Years for Heroin Possession Following Police Check**
1 min readShimla, 15 July 2024 – According to the prosecution, on the night of 29 November 2019, a police team was on patrol and conducting traffic checks near Taradevi at the Tuttu bifurcation on NH-5. At around 9:30 PM, a government Volvo bus traveling from Chandigarh to Shimla was stopped for inspection. A young man seated on seat number 17 was questioned about his travel, but he could not provide a satisfactory answer. The man identified himself as Rahul Chauhan, 23 years old, son of the late Surendra Chauhan, and a resident of Hatkoti village, Jubbal tehsil, Shimla district, Himachal Pradesh.
Rahul Chauhan was holding a white plastic bag in his lap. Upon searching the bag, the police found 10 grams of heroin inside a plastic packet. Subsequently, a case was registered against Rahul Chauhan at Baluganj police station under case number 272/19 on 30 November 2019. The police completed all necessary formalities on the spot, and the case was filed under Section 21 of the ND&PS Act.
During the trial, the prosecution presented testimonies from nine witnesses. District Attorney (Forest) Kapil Mohan Gautam represented the prosecution. Today, Special Court (Forest) Judge Devendra Kumar Sharma, considering the evidence, sentenced Rahul Chauhan to four years of rigorous imprisonment and imposed a fine of ₹25,000. In the event of non-payment of the fine, Rahul Chauhan will have to serve an additional six months of simple imprisonment.
