Shimla, Sept 9: The Himachal Pradesh High Court has held that execution petitions under Section 174 of the Motor Vehicles Act are subject to a 12-year limitation period. Setting aside a MACT order in Datta Ram & Others v. United India Insurance Co. Ltd., Justice Ajay Mohan Goel ruled that insurers must file recovery petitions within the prescribed period under the Limitation Act, 1963.
