Himachal Pradesh High Court Rejects Petition Challenging Cancellation of Hospital License

The Himachal Pradesh High Court has dismissed the petition challenging the decision to cancel the license of NR Hospital in Bilaspur. Justice Ajay Mohan Goyal made it clear that if the petitioner applies for a new license, this decision will not be a hindrance.

The Drug Controller had issued a show-cause notice to NR Hospital in violation of the rules. The petitioner had informed the court that an appeal had been filed against this notice. However, the competent officer had rejected the appeal. The hospital administration had moved a petition in the High Court against this decision. It was alleged in the petition that the appellate officer had wrongly rejected the appeal.

The government had argued that the hospital administration had not prepared records as per the rules. Even the documents for the purchase and sale of medicines were not received properly. On January 17, 2022, a drug inspector had issued a show-cause notice after inspecting the hospital. After reviewing the records related to the case, it was found that the hospital administration had received the notice and the department had agreed that the deficiencies had been rectified. For this reason, a show-cause notice under the rules was issued. The court found that the competent officer had not interfered with the decision.
