Employee does not have right to serve at one place for three years – HC

Shimla, April 06- The Himachal Pradesh High Court has given an important decision in the matter related to the transfer of the employee. The court said that no employee is entitled to serve at the same place for three years. A division bench of Acting Chief Justice Sabina and Justice Satyen Vaidya said that for administrative reasons, the government can transfer the employee at any time. The court gave this decision while rejecting the petition of the employee of the Forest Department. Petitioner Abdul Hamid had alleged that he had been transferred before three years. Citing the transfer policy, it was argued in the petition that a provision of three years has been kept for the employee to serve at one place.

However, the petitioner has just completed one and a half year tenure. It was alleged that he was transferred on political recommendation to accommodate the respondent. The Court, on perusal of the records of the case, observed that the petitioner was transferred from Churah Forest Division to Tundah Block Khajjiar on the basis of administrative exigencies. Dismissing the petition, the court said that the normal tenure of an employee cannot be said to be an absolute mandate in the transfer policy. The government reserves the right to transfer its employees anytime in public interest or administrative necessity
