Builders refund amount to complainant before pronouncement of order
2 min readShimla, Jan. 21 – A Spokesman of HP Real Estate Regulatory Authority stated here today that Authority had received 12 complaints from the different complainants against M/s Rajdeep & Company Infra Pvt. Ltd., & others. Out of which 11 complaints have been decided in the favour of allottees while one other complaint was pending for hearing in respect of the project named as Himalaya Residency located at Bharari, Shimla.
The Authority decided the 11 cases on merit basis by ordering/directing the refund of the amount paid by the allottees to the promoter developers for the refund of approximately Rs. Two crore with 9.3% interest and also imposed penalty for non-fulfilling of the obligations under the Real Estate (Regulation and Development) Act, 2016 worth Rs. 31 lakhs to be deposited in the RERA account for non-completion of obligation under the Act to be paid in two months failing which they have to pay a penalty of double the amount.
He said that the hearing for pronouncement of the order in case of Kanta John, resident of Auckland House School, Shimla against M/s Rajdeep & Company Infra Pvt. Ltd. & others was fixed on 19 January, 2021 to decide the refund of the amount of Rs. 8,71,680/-. The Counsel for Kanta John complainant/allottee in Block D of the project apprised that the respective promoter/builders have amicably settled to refund the amount paid to her worth Rs. 8,71,680/- with interest a total amount Rs. 10 lakhs. The Counsel for complainant also thanked HP RERA to take initiatives to settle the case.
Kanta John also submitted an application for withdrawal of the complaint having been settled between the parties amicably after receiving Rs. 10 lakh in her bank account paid by the builders to HPRERA which has been allowed. The Authority highly appreciated and acknowledged this amicable settlement between the parties in the present case. The Authority has expressed satisfaction over the fact that promoters are now taking interest to settle the complaints of allottees before pronouncement of orders.
